Project Acceptance Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of Neat Creative (operated by Bec Gauci, “Contractor”) services. By engaging Neat Creative, you agree to these Terms. If you have any questions, please contact us before proceeding.

1. Services

Neat Creative provides professional graphic design services. All services will be delivered based on the agreed-upon specifications outlined in the project proposal.

2. Project Proposals and Payments

  • Estimates and Scope: Proposals are estimates based on the initial brief and are subject to change if additional requirements or unforeseen circumstances arise. Additional costs, such as stock imagery or printing, will be outlined and approved prior to implementation.

  • Validity: Proposals are valid for 14 days from the date of issue.

  • Non-Refundable Deposit: A 50% non-refundable deposit is required to commence work. The remaining balance is due upon project completion, prior to delivery of final files.

  • Additional Charges: Changes beyond the agreed scope will be billed at $125+GST per hour.

  • Accepted Payments: Payment is accepted via bank transfer only.

3. Revisions

  • Scope of Revisions: Each project includes an agreed number of revision rounds as outlined in the project proposal. Additional revisions will incur extra charges, included in the final invoice.

  • Definition of Revisions: Revisions refer to minor changes such as adjustments to layout, text edits, or element positioning. Significant changes, such as designing new concepts, altering existing designs to become new concepts, or changing website themes, are not included.

  • Exclusions: Changes requiring substantial rework or additional concepts are outside the agreed scope and will be billed separately.

4. Sign-Off of Work

  • Final Approval: The Client is required to provide written approval for all completed design work. This written approval confirms the project is complete and no further amendments will be made.

  • Stage Approvals: For larger projects, written approval may be required at various stages of the design process before progressing to the next phase.

5. Revisions/Alterations

  • Content Finality: Content submitted to Neat Creative at the start of the project is considered final.

  • Additional Revisions: Any revisions, alterations, or new content provided by the Client after the project has commenced will be charged at $125+GST per hour.

6. Confidentiality

  • Client Responsibility: All works in progress, ideas, strategies, and other intellectual property must be held in strict confidence by the Client and shared only with the parties who are written signatories to the agreement.

  • Contractor Responsibility: Neat Creative will make every effort to protect the confidentiality of all information provided by the Client.

7. Copyright

  • Ownership of Finished Work: Copyright in all finished works remains the property of Neat Creative until full payment has been received.

  • Unused Designs: If multiple options are presented, all options except the chosen design remain the property of Neat Creative.

  • Client-Supplied Material: The Client agrees to indemnify Neat Creative against any claims, losses, or liabilities resulting from breaches of copyright related to materials provided by the Client.

8. Intellectual Property

  • Designer Rights: Neat Creative retains the rights to use any designs created for portfolio purposes unless otherwise agreed upon.

  • Client Rights: Upon full payment, the Client receives the rights to use the final design for its intended purpose. Working files, preliminary concepts, and unused designs are excluded unless explicitly agreed upon prior to project commencement.

9. Cancellations and Refunds

  • Cancellations: If the Client wishes to cancel the project, they must do so in writing. The deposit is non-refundable, and the Client will be billed for any work completed beyond the deposit amount.

  • Refunds: No refunds will be issued for completed work.

10. Limitation of Liability

  • Neat Creative is not liable for any indirect, consequential, or incidental damages arising from deliverables or services.

  • Clients indemnify Neat Creative from any claims or losses resulting from the use of supplied materials or designs.

11. Governing Law

These Terms are governed by the laws of Australia. Any disputes will be resolved under Australian jurisdiction.

12. Changes to Terms

Neat Creative reserves the right to update these Terms at any time. It is the Client’s responsibility to review the Terms periodically.
