1. Introduction
Welcome to Neat Creative (Bec Gauci’s) Graphic Design Services (“Contractor”). These Terms and Conditions ("Terms") govern your use of my website and services. By accessing or using our website and services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use my website or services.
2. Services
The Contractor offer various graphic design services, including but not limited to logo design, branding, web design, and print materials. All services will be provided as per the specifications agreed upon in the project proposal.
3. Project Proposals and Payment
Proposals: A detailed project proposal will be provided outlining the scope, timeline, and cost of the project.
All proposals are estimates based on the information provided by the Client and Suppliers. Proposals are subject to change based on final brief, content review or other circumstances that may affect the job. Proposals do not, generally, include, photography/illustration/copy writing or other ‘out of pocket’ expenses, these will be additional. Proposals are only valid for 14 days from date of issue.
It is agreed that the fee for service shall be the cost estimates provide. If work undertaken exceeds the scope of works, the Client agrees to pay appropriate fees for the excess work.
Payment Terms: A non-refundable deposit of 50% of the total project cost is required to begin work. The remaining balance is due upon project completion, before the final files are delivered.
Payment Methods: The Contractor accepts bank transfers only.
4. Revisions
The Contractor offers an agreed round of revisions for each project, outlined in the project proposal. Additional revisions beyond this may incur extra charges, which will be included in the final invoices.
Revisions are a minor change that is applied to the design presented in the first draft, this could include a tweak to the positioning of elements within the design and limited copy changes. This does not include the design of additional concept options, outside of the agreed number of concepts, or changing an existing concept to the point that it becomes a brand new concept or logo. This does not include the addition of any extra pages.
5. Client Responsibilities
Content: The Client must provide all necessary content, including text, images, and other materials, in a timely manner.
The Contractor does not accept liability or responsibility for copyright obligations on any material supplied by the Client or their Associates. It is a condition of engagement that the Client indemnify the Contractor against any claims or liability arising from use of such material supplied for the purpose of this project and thereby used by the Contractor for this project.
Feedback: Timely feedback is essential to ensure the project stays on schedule. Delays in feedback may result in extended deadlines.
Acceptances: The Client agrees to co-operate and the Contractor with everything needed to complete the Services as, when and in the format requested. The Client must nominate a person to be responsible for signing off on all content, changes or additional charges made during this project. The Contractor cannot be held responsible for changes made by unauthorised persons.
6. Intellectual Property
Designer Rights: The Contractor retains the rights to use any designs created for portfolio purposes unless otherwise agreed upon.
Client Rights: Upon full payment, the Client will receive the rights to use the final design for the intended purpose. This does not include rights to working files (unless otherwise agreed, preliminary work or concepts not used in the final design).
7. Cancellations and Refunds
Cancellations: If the Client wishes to cancel the project, they must do so in writing. The deposit is non-refundable, and the Client will be billed for any work completed beyond the deposit amount.
Refunds: No refunds will be issued for completed work.
8. Confidentiality
The Contractor respect your privacy and will not disclose any confidential information provided during the project without your consent. This includes any sensitive business information or personal data.
9. Limitation of Liability
The Client shall indemnify Neat Creative in full for all costs, losses either direct or indirect in any way incurred by the Client; and, where any such action by the Client causes loss or damage or liability of any kind howsoever to the Contractor in connection in any way with the Services rendered.
The Contractor is not liable for any indirect, incidental, or consequential damages arising from the use of the Contractors services.
10. Governing Law
These Terms are governed by the laws of Australia. Any disputes will be resolved in the courts of Western Australia.
11. Changes to Terms
The Contractor reserves the right to update these Terms at any time. Any changes will be posted on this page, and it is your responsibility to review these Terms periodically.
